Managing Loss of Pay (LOP)—or Leave Without Pay (LWP)—is one of the most common friction points between HR teams and employees. When an employee runs out of paid leave, takes unapproved time off, or joins mid-month, payroll must deduct pay accurately. Choosing the wrong daily deduction rate or misapplying weekend rules leads to salary disputes and compliance errors. Here is how to handle LOP calculations cleanly and compliantly. ## What Triggers Loss of Pay (LOP)? LOP occurs whenever an employee is absent and not entitled to compensation: ** Exhausted Balances**: Taking time off after using up all accrued Earned Leave (EL), Casual Leave (CL), and Sick Leave (SL). **Unapproved Absence**: Failing to punch in, missing shift regularizations, or taking unscheduled leaves without manager approval. **Mid-Month Joining or Exit**: When an employee starts after the 1st or leaves before the final day of the month, unworked days are deducted on a pro-rata basis. ### **The 3 Formulas for Calculating a Day's Pay** Indian companies generally use one of three methods to determine a single day's deduction: 1.** Actual Calendar Days (Most Common for White-Collar/SaaS)** ** ****Per Day Deduction = Monthly Gross Salary Total days in that Month ****** This method reflects the exact calendar period, though a day off in February costs slightly more than one in March 2. **Fixed 30-Day Divisor:** **Per day Deduction = Monthly Gross Salary 30** Standardizes daily deductions across every month, but causes slight distortions during 31-day months. 3. **26 Working Days (Factories Act / Industrial Model)**: Per day Deduction = Monthly gross Salary 26 Excludes the four statutory weekly offs (Sundays). It results in a higher deduction per absent day and is best suited for shift-based manufacturing or site operations. **The Sandwich Leave Rule** The Sandwich Policy prevents casual absenteeism around weekends and official holidays **How It Works**: If an employee takes unapproved leave on both Friday and the following Monday, the intervening Saturday and Sunday are also treated as unpaid LOP. **The Result**: Instead of losing 2 days of pay, the employee loses 4 full days of pay. **Compliance Note:** The rule must be explicitly written into your company handbook and employment contracts to prevent disputes under state Shops and Establishments Acts. **Impact on EPF and ESIC Compliance** LOP directly alters statutory calculations on the monthly payroll run: **EPFO Non-Contributing Period (NCP) Days**: Every LOP day must be reported as an NCP day in the monthly Electronic Challan cum Return (ECR) text file. Both employer and employee 12% EPF contributions are calculated on the reduced earned basic wage, not the theoretical full basic pay. **ESIC Contributions**: For covered employees, the 4% total ESIC deduction applies strictly to their reduced earned gross salary. A temporary dip in wages due to LOP does not make a higher-earning, exempt employee suddenly eligible for ESIC. **Summary ** Loss of Pay (LOP) applies when leave balances are zero, absences are unapproved, or an employee works a partial month during onboarding or exit. Daily deductions are typically calculated using the Actual Calendar Days method for corporate teams, or the 26-day method for industrial and manufacturing setups. The Sandwich Rule converts intervening weekends into unpaid days if absences occur on both surrounding days, but it requires clear contractual documentation. Statutory filings must reflect LOP by mapping unpaid days to NCP days in EPFO returns and computing PF and ESI contributions on earned wages rather than fixed contract wages.
